TICs e Inteligencia Artificial como apoyos para garantizar el derecho a la educación en adolescentes internados por salud mental

Abstract

Las niñas, niños y adolescentes internados por afecciones en su salud mental requieren una educación especial, por ello, el derecho argentino debe poner a disposición todas sus herramientas para garantizar ante dicho escenario, el acceso al derecho a la educación y a herramientas tecnológicas. Es el proceso educativo el que debe adaptarse a la particular condición del alumno y no el alumno adaptarse a las técnicas de la educación tradicional, por ello se propone analizar los aportes que las herramientas diseñadas en base a TICs e Inteligencia artificial pueden brindar en pos de dicho objetivo. En el desarrollo investigativo que propone este trabajo, se enaltece la figura de los “apoyos a la capacidad jurídica” como recurso permeable a los avances tecnológicos, que colaboran en el proceso de aprendizaje, y ayudan a concretar la meta de una educación inclusiva, como espacio de ampliación de derechos.

Girls, boys, and adolescents hospitalized for mental health conditions need a special education. Therefore, under this scenario, the Argentine law must make available all its instruments and policies to guarantee access to the right to education and technological tools. It is the educational process that must adapt to the particular condition of a student, and not the student who must adapt to traditional educational techniques. In pursuit of this goal, the proposal is to analyze the contributions that ICT-based Tools and Artificial Intelligence can provide. In the investigative development proposed by this work, the figure of "support for legal capacity" is exalted as a resource that should be permeable to technological advances which collaborate in the learning process and help to achieve the goal of an inclusive education as an opportunity for the expansion of rights.
