Las Funciones Sociales del Crimen y el Castigo: Una comparación entre las perspectivas de Durkheim y Foucault

Abstract

El objetivo del presente trabajo es examinar las posiciones de Durkheim y Foucault en torno a la cuestión criminal. Nuestra hipótesis más general es que ambos comparten la idea de un nexo funcional oculto entre transgresión criminal, castigo penal y orden social. Establecida esta coincidencia, buscaremos identificar sus principales contrastes. Aquí la hipótesis es que ambos autores elaboran modos distintos de comprensión de la constitución y reproducción de la sociedad y, en consecuencia, divergen en su interpretación de la historia de las penalidades tanto como en la importancia y el rol que otorgan a la cuestión criminal en los órdenes sociales modernos.

The aim of this article is to examine the positions of Durkheim and Foucault regarding crime. The author’s more general hypothesis is that both share the idea of a hidden functional nexus between criminal transgression, criminal punishment, and social order. Once established this agreement, he seeks to identify their main contrasts. Here, the hypothesis is that the two authors develop different modes of understanding the constitution and reproduction of a society, and, therefore, their interpretations of the history of punishment are different regarding both the importance and the role that they assign to the issue of crime in modern social orders.
