Relaciones entre derecho y literatura en la historia argentina: propuestas para su estudio desde la filosofía del derecho

Abstract

El presente trabajo se propone analizar los vínculos derecho y literatura en la historia argentina desde principios del siglo XIX hasta la actualidad. Desde los marcos teóricos que indagan la relación derecho-literatura, se estudiará las posibles articulación y funcionamiento de las producciones literarias en torno al espacio jurídico. Diferentes serán sus narraciones sobre el despliegue normativo, el uso de la fuerza, la protección de los cuerpos, la exclusión de la otredad y la construcción de la subjetividad. La tensión entre estética y normatividad abre nuevos canales de tematización y estudios interdisciplinarios desde la filosofía del derecho.

The present work aims to analyze the links between law and literature in Argentine history from the beginning of the 19th century to the present. From the theoretical frameworks that investigate the relationship between law and literature, the possible articulation and operation of literary productions around the legal space will be studied. Different will be his narratives on the normative deployment, the use of force, the protection of bodies, the exclusion of otherness and the construction of subjectivity. The tension between aesthetics and normativity opens new channels of theming and interdisciplinary studies from the philosophy of law.
