La inclusión de la perspectiva de género como desafío pedagógico para el Derecho Agrario

Abstract

Entre las diversas problemáticas incluidas en la necesidad impostergable de un abordaje jurídico en perspectiva de género, cabe destacar el —tantas veces invisibilizado— posicionamiento social de la mujer en el ámbito agropecuario, así como su impacto legislativo. En este sentido, y advirtiendo, si se quiere, que la actividad agraria estuvo (y aún está) pensada desde una matriz patriarcal, su análisis desde coordenadas que cuestionen a esa matriz adquiere una mayor actualidad y trascendencia. Dicho esto, el objetivo del presente artículo consiste en exhumar, a partir de la utilización de una hermenéutica jurídica sustentada en una metodología exploratoria, el tratamiento jurídico dado a la mujer rural y, luego, detenerse en el análisis de la necesidad de incluir la perspectiva de género tanto en el diseño curricular como en el proceso enseñanza-aprendizaje del Derecho Agrario. En esta tarea, resulta fundamental advertir la existencia de una particular característica disciplinar: la dinamicidad de su objeto de estudio, circunstancia ésta que complejiza aún más el desafío didáctico propuesto.

Among the different problems included in the imperious necessity of a juridical approach in gender perspective, we highlight here the particular social positioning of women in agricultural areas as well as its legal impact. In this sense, and considering that the agricultural activity has always been thought from a patriarchal matrix, this analysis currently becomes more significant. Having said that, the goal of this article is to exhume, from a juridical hermeneutic supported on an exploratory methodology, the treatment given to rural women and, then, focus both on gender perspective inclusion in the curricular design and, from there, on the teaching-learning process of Agrarian Law. To achieve this, it is fundamental to take into account the presence of a particular discipline characteristic: the dynamicity of its object of study; this circumstance makes the proposed didactic challenge even more complex.
