El mecanismo de acceso a recursos genéticos y distribución de beneficios, regulado por el novedoso Protocolo de Nagoya, establece un marco legal internacional predecible, transparente y justo para el acceso e intercambio de material genético y de conocimientos tradicionales asociados a su utilización. Varios países de la región, entre los que se encuentran Argentina, Brasil, Perú, Colombia, Ecuador, Panamá y Costa Rica se encuentran abocados a adoptar y/o actualizar sus políticas y legislación en la materia. La experiencia sin embargo demuestra que la implementación nacional de regímenes de acceso y distribución de beneficios ha resultado una tarea poco exitosa. En consideración a ello esta investigación analiza las fortalezas y limitaciones más destacables que presentan las legislaciones sobre el tema en tres países del continente americano: Perú, Costa Rica y Estados Unidos. Entre las primeras se destaca una tendencia a simplificar el procedimiento para acceder a recursos genéticos con fines puramente científicos, facilitándose de este modo, la investigación básica sobre biodiversidad. Por otro lado, las limitaciones más importantes se refieren a la falta de regulación en temas esenciales, a la escasa visión estratégica a la hora de priorizar y negociar beneficios, y a una cierta tendencia a debilitar el control que ejercían efectivamente los puntos de verificación encargados de garantizar la legalidad del acceso a recursos genéticos. Al finalizar, el estudio ofrece algunas pautas recomendables para el desarrollo y modificación de regímenes de acceso y distribución de beneficios.

The mechanism for access to genetic resources and benefitsharing governed by the Nagoya Protocol establishes a predictable, transparent and fair international legal framework for access to and exchange of genetic material and traditional knowledge associated with its use. Several countries in the region, including Argentina, Brazil, Peru, Colombia, Ecuador, Panama and Costa Rica, are committed to adopting and/or updating their policies and legislation in this area. Experience, however, shows that the national implementation of access and benefit-sharing regimes has been an unsuccessful task. In consideration of this, this research analyzes the most notable strengths and limitations presented by legislation on the subject in three countries of the American continent: Peru, Costa Rica and the United States. Among the former, there is a tendency to simplify the procedure for accessing genetic resources for purely scientific purposes, thus facilitating basic research on biodiversity. On the other hand, the most important limitations relate to the lack of regulation on essential issues, the inexistence of a strategic vision to prioritize and negotiate benefits, and a certain tendency to weaken the control effectively exercised by the checkpoints responsible for ensuring the legality of access to genetic resources. At the end, the study offers some recommendations for the development and modification of access and benefit-sharing regimes.
