Abordando la seguridad pública desde la Filosofía del Derecho

Abstract

Desde su nacimiento, el Estado, para esgrimir su carácter de soberano, se constituyó en el único juez y el único habilitado para reprimir; capaz de inventar el derecho, y de garantizar su aplicación. Desde esta perspectiva, el Estado no puede ser nunca violento: la violencia del Estado es siempre una búsqueda y una construcción de la “paz”; si se reprime o castiga, será siempre en nombre de la libertad y el bienestar de sus ciudadanos. Sin embargo, la fundamentación de esta idea muestra flancos conceptuales y materiales. El presente artículo pretende indagar acerca de dónde emana la legitimidad de los Estados para definir de antemano las formas normales de vivir, arrogándose al mismo tiempo el derecho de reprimir y castigar aquellas prácticas consideradas desviadas. Para ello, se abordarán cuatro cuestiones: a) ¿qué es el Estado?; b) ¿desde cuándo existe?; c) ¿cómo castigar a los infractores de las normas públicas?; y d) ¿cómo compatibilizar seguridad y libertad?

Since it emerged and to uphold its sovereign character, the State established itself as the only judge, with exclusive powers to exert repression, create the law and guarantee its application. From this perspective, the State can never be violent: State violence is always a search for and a construction of “peace”. If someone is repressed or punished, it will always be in the name of the freedom and welfare of citizens. However, the foundation of this idea has conceptual and material aspects. The present article enquires into the origins of the legitimacy of the State to define in advance normal ways of living, claiming at the same time the right to repress and punish practices considered deviant. To this purpose, four questions will be addressed: a) What is the State?, b) Since when does it exist?, c) How are offenders of public standards punished?, and d) How can security and freedom be reconciled?
