Abstract

El presente ensayo tiene por objeto problematizar y profundizar desde una perspectiva contemporánea la especial técnica de reproducción humana asistida como lo es la fertilización post mortem. Para este fin, se toman, a modo de excusa o disparador, recientes planteos judiciales esgrimidos en tres ordenamientos jurídicos con realidades y legislaciones bien diferentes como lo son Argentina, Francia y Gran Bretaña, a los cuales también se debe sumar España siendo que uno de estos precedentes involucra a la regulación española. Estas sentencias son hábiles también para revisar la noción de “progreso o “progresismo” en el campo de las técnicas de reproducción humana asistida y a la par, problematizar sobre la admisión irrestricta, estricta o intermedia en la temática. En otras palabras, se pretende indagar sobre el rol de los límites al momento de edificar una ley y su posible tensión con el derecho humano a gozar de los beneficios del progreso científico.

This paper is to problematize and deepening from a contemporary perspective the special technique of assisted human reproduction as is the post mortem fertilization. To this end, it is taken as an excuse or trigger recent court cases put forward in three legal systems realities and laws very different as is Argentina, France and Britain, which must also add Spain being one of these precedents also it involves the Spanish regulation. These statements are also working to revise the notion of "progress or" progressivism" in the field of assisted human reproduction and at par, problematize on the unrestricted, intermediate or strict admission to the theme. In other words, it aims to investigate the role of limits when building a law and its possible tension with the human right to enjoy the benefits of scientific progress.
