Justicia de transición y democracia. Notas sobre la actualidad de una relación conceptual

Abstract

Buscamos en este breve artículo discutir las principales estrategias político-jurídicas de la justicia de transición. Considerando rápidamente las dimensiones normativas e institucionales de la democracia buscaremos abordar el cambio de paradigma político en juego en la aplicación de la justicia transicional. Por un lado, hay una clara resignificación de las narrativas hegemónicas que están en negociación, pero por otro, muchas de esas concesiones políticas siguen impregnadas de las causas que llevaron al conflicto armado y al terrorismo de Estado. Las comisiones de la verdad en nuestro continente aportaron a una consolidación de la democracia en un contexto de contingencia política. A pesar de las diversas dificultades, esas jóvenes democracias pudieron iniciar una transición que, años más tarde, derivó en una nueva instancia investigativa. De este modo, buscamos sostener que la democracia está en constante reconstrucción a partir de la consolidación de los marcos normativos que toman en cuenta toda la dimensión del conflicto político. La elaboración del pasado en ese nuevo marco institucional revela que los motivos que llevaron al conflicto social y al terrorismo de estado todavía siguen latentes y deberían ser investigados en clave del derecho civil y penal.

We seek in this brief article to discuss the main political-legal strategies of transitional justice. Considering quickly the normative and institutional dimensions of democracy, we will seek to address the political paradigm shift at stake in the application of transitional justice. On the one hand, there is a clear resignification of the hegemonic narratives that are in negotiation, but on the other hand, many of these political concessions continue impregnated of the causes that led to the armed conflict and the terrorism of State. The commissions of truth in our continent contributed to a consolidation of democracy in a context of political contingency. Despite the various difficulties, these young democracies were able to initiate a transition that, years later, led to a new investigative instance. In this way, we seek to maintain that democracy is constantly being rebuilt from the consolidation of normative frameworks that take into account the whole dimension of political conflict. The elaboration of the past in this new institutional framework reveals that the motives that led to social conflict and state terrorism still remain latent and should be investigated in the light of civil and criminal law.
