El concepto jurídico de persona y los derechos de los animales

Abstract

Este artículo pretende discutir acerca de los alcances del concepto jurídico de “persona” y, en particular, si este abarca los animales no humanos como sujetos susceptibles de adquirir derechos y obligaciones. Ello, en tanto si se afirma que los animales no humanos tienen derechos, entonces, se los puede considerar personas en el sentido en que la teoría general lo ha hecho. En cambio, si se niega esta capacidad, se señalaría que el concepto jurídico de persona tiene un campo semántico restringido (solo humanos). Por este motivo, a efectos de dilucidar el sentido de esta noción, es necesario reconocer sus alcances. Palabras clave: persona, juspositivismo, jusnaturalismo, derechos animales.

This article aims to discuss about the limits of the legal concept of person and, in particular, if it includes or not the non-human animals as subjects that can acquire rights and obligations. If we affirm that non-human animals have rights, then, we can consider them persons in the sense that general legal theory usually does. On the opposite, if we deny that capacity, we would sentence that the concept of person has a strict meaning (only humans). According to this, in order to clarify the sense of this term, it is necessary to analyze its limits.
