Desafíos de la responsabilidad ambiental: necesidad de una tutela anticipada y preventiva

Abstract

A través del presente trabajo se considera la importancia de la prevención en materia de responsabilidad ambiental para la protección del derecho humano a un ambiente en un Estado democrático de derecho. Se establecen como objetivos realizar, en primer lugar, un breve análisis de la lógica dependencia entre democracia, derechos humanos y el derecho-deber al medio ambiente, abordando la dimensión ambiental del problema, para luego focalizar la necesidad de una tutela anticipada y preventiva en materia de responsabilidad y la esfera de la colectivización en el deber de protección del medio ambiente, haciendo especial énfasis en el rol del juez en materia ambiental.

This paper considers the importance of prevention in environmental responsibility for the protection of the human right to a healthy environment in a democratic state of law. First, the paper makes a brief analysis of the logical dependence between democracy, human rights and the right and duty to a healthy environment, then focus in the need for early and preventive custody in the duty to protect the environment (with collectivization of the duty), with particular emphasis on the role of judges in environmental matters.
