La filiación por técnicas de reproducción humana en el Código Civil y Comercial argentino: un avance que permite armonizar la norma con la realidad

Abstract

Este artículo describe los aportes y cambios que el Código Civil y Comercial argentino introduce en la filiación. En particular, la atención se traslada a la filiación por técnicas de reproducción humana asistida en vinculación con el consentimiento informado como exteriorización de la voluntad procreacional. Asimismo, se destina un espacio al estudio de dos procedimientos que fueron silenciados en la norma como la gestación por sustitución y la fecundación post mortem.

This article describes the contributions and changes that the Argentinian Civil and Commercial Code introduce in the filiation. The focus of attention is moved to the assisted human reproduction techniques in relation with the informed consent as an exteriorization of the will to procreate. Moreover, it is intended a study space about two proceedings that were silenced in the norm as the gestational surrogacy and the post mortem fertilization.
