Sobre lo que el Derecho le debe a la Filosofía

Abstract

El presente trabajo se propone reflexionar sobre la necesaria integración entre filosofía y derecho, especialmente en lo que hace al estudio teórico del derecho y su enseñanza. A fin de probar dicha necesidad, analizaremos un problema teórico fundamental del Derecho Penal, la noción de dolo, y mostraremos su relación con la noción de sujeto propia de la filosofía moderna. Proponemos analizar la noción de dolo a la luz de la noción filosófica de sujeto, y así intentar mostrar no soloque están emparentadas, sino también que los problemas que la noción de dolo padezca se encuentran directamente relacionados con los defectos de la noción moderna de sujeto.

This paper intends to reflect about the necessary integration between philosophy and Law, especially when we are dealing with the theoretical study of Law and its teaching. In order to prove the need of this integration, I intend to analyze a fundamental theoretical problem of Penal Law, the notion of specific intent, and to show its relation with the notion of subject proper of the Modern Philosophy. I intend to analyze the notion of specific intent in the light of the philosophical notion of subject, and so intend to show not only that they are related, but that the problems aroused by the notion specific intent are due also to the modern notion of subject.
