La Comunidad Política Soberana entre la Teoría Pura del Dercho y el Desicionismo: El concepto de soberanía en Hermann Heller

Abstract

La Soberanía del filósofo y jurista alemán Hermann Heller, libro aparecido en 1927, constituye la base del presente artículo. El mismo se dedica a estudiar el concepto de soberanía en el pensamiento de Hermann Heller con el fin de relacionarlo, primero, al contexto histórico de la República de Weimar y las corrientes jurídico-filosóficas precedentes y, segundo, de contrastarlo cuidadosamente con dos pensadores contemporáneos de Heller, a saber, Carl Schmitt y Hans Kelsen. De esta manera, la autora afirma que Hermann Heller se sitúa entre el voluntarismo existencialista representado por Carl Schmitt y el positivismo de Hans Kelsen, creando importantes antecedentes para la actual concepción de la soberanía en el Derecho Internacional.

This article is based on The Sovereignty, book written in 1927 by the german philosopher and jurist Hermann Heller. It studies the concept of sovereignty in the thought of Hermann Heller in order to establish, first, a relationship between the historical context of the Weimar Republic and it’s precedent philosophical and juridical currents and, second, to contrast Heller’s concept of sovereignty with two contemporary thinkers, namely Carl Schmitt and Hans Kelsen. Thus, the author states that Hermann Heller stands between the existentialist voluntarism represented by Carl Schmitt and Hans Kelsen’s positivism, and that he has created a significant background for the current conception of sovereignty in international law.
