El caso de Luis: moralidades, emociones y dispositivos penales de "perdón"

Abstract

El artículo propone reflexionar sobre el perdón como valor que organiza las relaciones que se despliegan en torno al tratamiento penal de la figura de inimputabilidad. Para ello se apoya en el análisis de una intervención en particular: el caso de Luis, quien fue procesado por varios asesinatos ocurridos en la década de 1980 en Argentina. Este recorrido se ofrece como explicación posible acerca del modo en que, dentro del funcionamiento del sistema penal, la mediación moral distingue emociones como forma de sustentar decisiones y prácticas determinadas. Al mismo tiempo se describen las transformaciones históricas que tuvieron lugar en una serie instituciones encargadas del tratamiento de Luis a lo largo de los veintiocho años de su internación.

The article The case of Luis: Moralities, Emotions and the Penal Device of ‘Forgiveness’ proposes to reflect on “forgiveness” as a value that organizes the relations that develop around the penal treatment of the figure of unaccountability. This opinion is supported by the analysis of a specific intervention: the case of Luis, charged with several murders in the 1980s in Argentina. This case is offered as a possible explanation of how, in the workings of the Criminal Justice System, moral mediation distinguishes emotions as a way of supporting certain decisions and actions. At the same time, a description is presented of the historical transformations that have occurred at institutions where he has been treated over the course of 28 years of confinement.
