Más sobre quórum y mayoría en la Corte Suprema: sentencias 2-1 en un tribunal de cinco miembros

Abstract

Este artículo desarrolla una investigación comenzada en otro anterior, con relación al modo en que deben computarse las mayorías en la Corte Suprema. Se pone de manifiesto la relevancia del concepto de quórum y sus virtualidades en el ámbito de los tribunales colegiados. Se concluye que, durante un período importante de su historia, la Corte Suprema Argentina computó la mayoría sobre el quórum, a la americana.

This article explores the notions of quorum and majority in the argentine Supreme Court. Drawing from previous research it shows the analogies and differences between the argentine system and the one of the United States . It concludes that for a long period of time the argentine Supreme Court counted majorities following the american way.
