Contestación social y acción legal: La (otra) disputa por los derechos

Abstract

En este trabajo nos proponemos rastrear un tipo de disputa de derechos emergente por fuera del campo político oficial, originado en nuevas conflictividades políticas y sociales. Estas luchas comparten una inscripción creciente de sus formulaciones alternativas y demandas en los principios jurídicos y acciones legales de la democracia constitucional y representan una respuesta a los cuestionamientos a la representación político-institucional, sus mutaciones y déficits. A partir de un análisis de tres casos de movilización socio-legal, subrayamos el rol del activismo jurídico y judicial en la estructuración de los conflictos y profundizamos en sus características específicas. También ubicamos las actuales luchas por derechos en el marco de los ciclos de movilización de la democracia argentina contemporánea y señalamos algunos de sus efectos inmediatos y desafíos pendientes.

In this work, we set out to trace a type of rights-based struggle emerging from outside the official political sphere and originated in new social and political conflicts. These struggles share a growing enrollment of their alternative formulations and demands into the juridical standards and legal actions of constitutional democracy and they represent a response to contested politicalinstitutional representation, as well as to its transformations and deficits. Based on an analysis of three processes of socio-legal mobilization, we highlight the role of juridical and judicial activism in structuring the conflicts and assess its specific features. Further, we locate the current struggles for rights into the cycles of mobilization of contemporary Argentine democracy and point out some of their immediate effects and pending challenges.
