Juego de artificios: Prácticas jurídicas y estrategias judiciales frente al fenómeno de la sodomía en la España moderna

Abstract

Durante los siglos XVI y XVII, la sodomía femenina constituyó una materia de difícil tratamiento. Mientras algunos autores planteaban que las mujeres no podían ser sujetos de ese crimen otros sostenían que podían serlo aunque para ello la cópula debía desarrollarse bajo determinadas condiciones. A partir del análisis de tratados jurídicos, teológicos y médicos que durante el período abrevaron en el tema así como de algunos procesos judiciales seguidos contra mujeres acusadas de haber cometido el delito de sodomía, este trabajo se propone indagar en la práctica jurídica de los agentes encargados de administrar justicia así como de las acusadas a fin de revelar qué concepciones prevalecieron en el tratamiento del delito.

During the 16th and 17th centuries, female sodomy was a matter of difficult treatment. While some authors raised that women could not be subjects of that crime, others argued that they could be it, but for this the intercourse had to be developed under certain conditions. Based on the analysis of legal, medical and theological treaties that approached to the subject during the period as well as some legal proceedings followed against women accused of having committed the crime of sodomy, this work intends to inquire into the legal practice of officials responsible for the administration of justice as well as the accused woman in order to reveal what conceptions prevailed in the treatment of crime.
