El presente artículo parte de la diferenciación entre sociedad y comunidad como una distinción moderna que permite poner al descubierto dos tipos de racionalidad práctica. A fines del s. XX el debate entre comunitarismo y liberalismo en ciencia política permitió replantear la pregunta por la comunidad ante la crisis del Estado (social) de derecho y los desafíos que la globalización ha establecido en las sociedades contemporáneas, caracterizadas por una creciente heterogeneidad valorativa y cultural y un individualismo arraigado. En este contexto de carencia de acuerdos morales básicos una pregunta central atraviesa tanto al derecho como a la política: ¿qué tipo de institucionalidad podrá garantizar la convivencia entre distintas y antagónicas concepciones sobre el bien? En este punto se sugieren algunas críticas al Estado a quien se presenta como uno de los mayores responsables en desencadenar los procesos de crisis y ruptura de los vínculos sociales. La hipertrofia de sus burocracias y las formas de especialización político-jurídicas han diluido la conciencia cívica en favor de lógicas clientelares limitando el desarrollo de la solidaridad entre los distintos agentes de la sociedad civil. Si, como sostiene el filósofo contemporáneo Alasdair MacIntyre, el Estado carece de aptitudes para educar ética y políticamente a sus ciudadanos, entonces el derecho no puede presentarse sino como una andamiaje para encausar y, sobre todo, sostener e incentivar los crecientes niveles de litigiosidad. Como alternativa se propone pensar formas de comunidad que promuevan relaciones intersubjetivas no sustentadas en una racionalidad instrumental, evitando pensar la justicia como sólo alcanzable a través del conocimiento especializado del derecho. This article is based on the distinction between society and community as a modern distinction allows to uncover two types of practical rationality. At the end of s. XX debate between communitarianism and liberalism in political science reframe the question allowed the community to the crisis (social) rule of law and the challenges that globalization has set in contemporary societies, characterized by growing valuation and cultural heterogeneity and rooted individualism. In this context of lack of basic moral agreements a central question through both the right and the policy: what kind of institutions can ensure the coexistence of different and conflicting conceptions of the good? At this point some criticism of the State who is presented as one of the major culprits in triggering processes of crisis and breakdown of social ties are suggested. Hypertrophy of their bureaucracies and political-legal forms of specialization have diluted the civic awareness of client logic for limiting the development of solidarity between the different actors of civil society. If, as argued by philosopher contemporary Alasdair MacIntyre, the state lacks ethically and politically skills to educate its citizens, then the law can not stand but as a scaffolding to prosecute and, above all, support and encourage increased levels of litigation. As an alternative we propose to consider ways to promote community intersubjective relations not supported by an instrumental rationality, avoiding thinking justice as achievable only through the specialized knowledge of the law.
