La forma legal de lo ilegal: la legislación represiva nacional y su incidencia en la provincia de Córdoba (1973-1976)

Abstract

El presente trabajo analiza la legislación de excepción y la conformación del Estado represivo durante el tercer gobierno peronista en la Argentina. Específicamente, aborda el caso de la provincia de Córdoba en tanto fue allí donde se materializó, tempranamente, un proceso orientado a desmovilizar y terminar con la “amenaza subversiva” a mediados de la década de 1970. La idea central que guía el trabajo es que las modificaciones a la estructura normativa, que dieron nueva forma al andamiaje institucional, otorgaron un marco jurídico a la lucha contra los sectores que, por ese entonces, eran calificados como subversivos por las autoridades provinciales y nacionales.

The following piece analyzes the exception legislation and the establishment of the repressive State during the third Peronist government in Argentina. It deals, specifically, with the case of Córdoba, as it was there where a process oriented to demobilize and finish the “subversive threat” materialized early in the 1970s. The central idea of the article is that the alterations to the regulatory apparatus, which reshaped the institutional structure, provided a legal framework to the combat against the social sectors that, by then, were labelled as subversive by the provincial and national authorities.
