Encontrar al terrorista: de la Seguridad Nacional al Código Penal

Abstract

Este artículo analiza la relación establecida entre prácticas de recuperación territorial mapuche y la aplicación del código penal en diferentes momentos de la historia reciente. Con este fin seleccionamos dos eventos: la recuperación de la Corporación Interestadual Pulmarí (año 1995) y de la Lof en Resistencia (año 2015), significativos en tanto en ambos casos la intervención legal y administrativa no se dirimió exclusivamente en términos de “propiedad privada”, sino que apeló a la noción de “seguridad”. Dado que los casos se dan en contextos históricos nacionales e internacionales de discusión y legislación diferentes y que recientemente se ha sancionado en Argentina una ley antiterrorista, nos preguntamos sobre los efectos performativos que estos cambios discursivos y legales han tenido en la definición de las subjetividades políticas. El trabajo centra su análisis en documentos que, producidos por diferentes agencias estatales, construyen y presentan una asociación particular entre el evento, los actores y las ideas de peligro.

This article examines the relationship between Mapuche practices of territorial recovery and the application of the Criminal Code at different times in recent history. To this end we selected two events: the recovery of the interstate corporation Pulmarí (1995) and Lof in Resistencia (2015). In both cases the legal and administrative intervention was not litigated exclusively in terms of “private property” but appealing to the notion of “security “. Given that these cases occur in national and international historical contexts of different discussions and legislations, and that recently there has been enacted in Argentina an anti-terrorism law, we wonder about the performative effects that these discursive and legal changes have had on the definition of political subjectivities. The work focuses its analysis on documents produced by different state agencies, attempting to offer a particular view on the relationship between the event, actors and ideas of danger.
