Brasil y la promoción de Tratados Bilaterales de Inversión: El fin de la disyuntiva

Abstract

En los últimos meses del 2013, Brasil modificó su tradicional rechazo a negociar y subscribir BITs debido al inicio de negociaciones con cuatro naciones africanas para concluir este tipo de acuerdos. El avance de las empresas multinacionales brasileñas ha provocado el fin de disyuntiva de adherirse a este tipo de instrumento de facilitación y protección de inversiones. A pesar de que la propuesta brasileña intenta despegarse de los tradicionales BITs incorporando nuevas aspectos que matizan las relaciones de poder entre país inversor y país receptor, el hecho pone de manifiesto las limitaciones que tiene la actual retórica brasileña de avanzar hacia una profunda transformación del orden internacional vigente

In the last months of 2013, Brazil modified their traditional refusal to negotiate and sign BITs due to the start of negotiations with four African Nations to conclude such agreements. The advance of Brazilian multinational companies has caused the end of the dilemma of adhering to this type of instrument of facilitation and protection of investments. While the Brazilian proposal tries to move away of the traditional BITs incorporating new aspects that seek to clarify the relations of power between home-country and hostcountry, this event highlights the limitation that has the current rhetoric of Brazilian move towards a profound transformation of the existing international order
