Dictámenes, Penas, Sentencias y Nupcias Secretas en las Dispensas Matrimoniales en territorios de la actual Argentina. Siglos XVIII-XIX

Abstract

El presente trabajo hace referencia a un interesante Dictamen fiscal del año 1809 –redactado en Córdoba del Tucumán- para que los Obispos locales pudieran dispensar grados de parentescos en los pedidos matrimoniales. Asimismo, las penas y sentencias que se expidieron en los casos de “desórdenes nupciales” en donde los lazos de consanguinidad y afinidad estrecha produjeron la nulidad de algunos matrimonios los que llegaron, en ocasiones, hasta la excomunión. Este anatema significó para el imputado la marginalidad social, política y económica en la sociedad, siempre que la disposición no fuera revertida. Se agregan menciones y ejemplos sobre las nupcias secretas cuyas partidas fueron anotadas en Libros diferentes a los de Matrimonios en aquel Obispado y, en Buenos Aires. Las fuentes de sentencias así expedidas, conforman páginas peculiares en épocas monárquicas y de la posterior independiente en territorios de la actual Argentina.

The present work refers to an interesting fiscal Opinion of the year 1809 - written in Cordova of the Tucumán - in order that the local Bishops could distribute degrees of kinships in the matrimonial orders. Likewise, sorrow and judgments that were sent in the cases of "wedding disorders" where the bows of consanguinity and affinity it reduces produced the nullity of some marriages those that came, in occasions, up to the excommunion. This anathema meant for the imputed one the social, political and economic marginality in the company, providing that the disposition was not reverted. They add references and examples on the secret nuptials which items were annotated in Books different from those of Marriages in that one Bishopric and, in Buenos Aires. The sources of judgments like that sent shape peculiar pages in monarchic epochs and in the later independent one from territories of the current Argentina.
