La libertad individual como fundamento del Estado: una revisión de la distinción entre Estado y sociedad en Ernst-Wolfgang Böckenförde

Abstract

El propósito de este trabajo es restituir el modo en que Böckenförde concibe la distinción entre Estado y sociedad a la luz de su concepción del Estado. Para esto, se presenta una estructura en tres partes. En primer lugar, nos detenemos en el modo en que Böckenförde concibe la justificación ética del Estado a partir de un análisis de su surgimiento como producto del proceso de secularización. En segundo lugar, restituimos el significado que adopta en ese marco la distinción entre Estado y sociedad. En tercer lugar, introducimos las reflexiones del autor sobre las posibilidades actuales de conservar esa distinción. Por último, recapitulamos lo dicho y esbozamos algunas conclusiones.

The purpose of this paper is to reconstruct Böckenförde’s conception of the distinction between state and society in light of his broader understanding of the State. To that end, the work is structured in three parts. First, it examines how Böckenförde conceives the ethical justification of the state through an analysis of its emergence as a product of the secularization process. Second, it reconstructs the meaning that the distinction between state and society acquires within that framework. Third, it introduces the author’s reflections on the current possibilities of preserving that distinction. Finally, the paper summarizes the key points and outlines some concluding remarks.
