Desigualdades estructurales en trabajo y cuidados: Las demandas en curso en el sistema interamericano

Abstract

La desigualdad estructural es un rasgo constitutivo de la región de América Latina, reflejada en la injusta división sexual del trabajo y del cuidado, y que afecta el ejercicio de derechos, en particular de las mujeres. El artículo parte por destacar algunos de los legados más importantes en la trayectoria de la profesora Cecilia Medina, para posteriormente concentrarse en desarrollar la conceptualización del trabajo y del cuidado, la consideración en la normativa en las regulaciones civiles y de derecho de familias, en el derecho laboral y de seguridad social. Luego se concentra en la definición del cuidado como derecho humano (el derecho a cuidar, ser cuidado y al autocuidado) y su anclaje en el sistema de derechos humanos, junto con su incorporación en la agenda pública en América Latina y su actual tratamiento en la Corte Interamericana de Derechos Humanos.

Structural inequality is a constitutive feature of the Latin American region, reflected in the unjust sexual division of labor and care, which affects the exercise of rights, particularly those of women. The article begins by highlighting some of the most significant legacies in professor Cecilia Medina’s career, and then focuses on developing the conceptualization of work and care, including its incorporation into regulations in civil and family law, labor law, and social security law. In a subsequent section, it then focuses on the definition of care as a human right (the right to care, to be cared for, and to self-care) and analyzes the anchoring of care in the human rights system, starting by considering that the right to care, to be cared for, and to self-care have been recognized, along with its incorporation into the public agenda in Latin America and its current treatment in the Inter-American Court of Human Rights.
