El Parricidio como fundamento de la ley: Una lectura de “Tótem y Tabú” desde la perspectiva de León Rozitchner

Abstract

El presente trabajo comienza con una primera parte que resume el mito científico de Freud en Tótem y Tabú, en el que se muestra el parricidio como acto fundacional de la ley paterna. Luego de esta presentación se desarrolla la lectura de la obra mencionada realizada por el filósofo argentino León Rozitchner. Según este autor Freud es quien da cuenta de la determinación histórica en la subjetividad, tratando de mostrar la manera en que la historia está presente articulando y organizando represivamente el aparato psíquico. Pero al mismo tiempo, en dicha obra se advierte la posibilidad de un cambio radical en las condiciones de la vida oprimida. La alianza fraterna instituye, en el espacio dejado por el patriarca asesinado, el fundamento radicalmente contingente de la autodeterminación y de la igualdad. En la tercera parte del trabajo se presenta, en contraste, la concepción lacaniana de Pierre Legendre del Padre como Referencia, como condición necesaria del orden simbólico en el que se inscribe el sujeto. En las conclusiones se desarrolla una concepción posfundacionalista de la ley que se apoya en esta lectura de Tótem y Tabú realizada por Rozitchner.

The present paper begins with a first section which resumes the “scientific myth” that Freud expounds in Totem and Taboo, where the parricide is indicated as a foundational act for paternal law. After this presentation it is developed a reading of the quoted book made by the Argentinian philosopher León Rozitchner. According to this author, Freud accounts for the historical determination of subjectivity, by trying to demonstrate the way that history is found in it, articulating and organizing repressively the “psychic apparatus”. But, at the same time, in that work the possibility of a radical change in the conditions of the oppressed life is noted. The “fraternal alliance” establishes, on the space left by the murdered patriarch, the radically contingent foundation of self-determination and equality. In the third section of this paper, it is presented, in contrast, Pierre Legendre’s Lacanian idea of the Father as “Reference”, as a necessary condition for symbolic order in which the subject is inscribed. In the conclusions it is explained a “postfoundationalist” view of the law that has its basis in the interpretation of Totem and Taboo made by Rozitchner.
