(Des)Ficcionalizar la ley: notas para un estudio iusliterario del silencio

Abstract

El presente trabajo tiene como objetivo analizar la articulación del silencio en la narrativa del derecho. El estudio se desarrollará mediante una metodología cualitativa. Se utilizarán los marcos interpretativos que ofrecen las categorías teóricas que indagan la relación entre el derecho y la literatura, así como las herramientas conceptuales propuestas por los estudios críticos del discurso. Para ello, se identificarán diferentes enunciados jurídicos a los fines de vislumbrar conexiones con otros discursos, las prácticas de sus agentes y su posterior desarrollo en el imaginario social. El texto propone una estructura progresiva dispuesta en diferentes apartados, a saber: estudios preliminares sobre el tópico del silencio; visibilización de las articulaciones narrativas y aplicación de las categorías iusliterarias. La investigación pretende concluir que un estudio interdisciplinario en torno al silencio visibilizaría otras narrativas que emergen de los márgenes de la ley, al mismo tiempo que permitiría replantearlas y restablecer su origen poético.

This work aims to analyze the articulation of silence in the narrative of law. The study will be developed using a qualitative methodology, from the interpretive frameworks offered by the theoretical categories, that investigate the relationship between law and literature and the conceptual tools proposed by critical discourse studies. The article will identify the different languages of law their relationships with other discourses, the practices of their agents and their development in the social imaginary. The text proposes a progressive structure organized in different sections: preliminary studies on the topic of silence; visibility of narrative articulations and application of ius-literary categories. The research aims to conclude that an interdisciplinary study of the silence would make visible other narratives that emerge from the margins of the law, at the same time that it would allow them to be reconsidered and reestablish their poetic origin.
