Entrelazando libertades: Por una (re)interpretación relacional de la objeción de conciencia ante salud sexual y – no – reproductiva

Abstract

Los movimientos feministas inauguraron nuevas formas de regular al cuerpo sexuado y, al hacerlo, también forzaron a quienes defienden una moral neoconservadora en temas sexuales, a innovar y mutar en su defensa. En ese marco, este trabajo se propone abordar la figura de la objeción de conciencia (OC) ante salud sexual y – no – reproductiva, para pensar en (re)formulaciones interpretativas que sean el punta pie para que, desde el discurso de los derechos, se piensen posibles regulaciones respetuosas de los derechos humanos de las mujeres al mismo tiempo que es una propuesta de construcción de ciudadanía frente a tejidos sociales saturados de políticas de odio.Propongo una re interpretación de la OC ante la legalización de las interrupciones de embarazos, a la luz de la autonomía relacional. A tales fines, analizo el caso de Argentina, teniendo en consideración el contexto sociopolítico actual, la trascendencia de los movimientos feministas en dicho país, así como la instrumentalización del concepto de libertad, efectuada por los movimientos políticos neoconservadores que en Argentina se han dado de llamar “libertarios”.

Feminist movements inaugurated new ways of regulating the sexualized body and, in doing so, also forced those who defend a neo-conservative morality in sexual matters to innovate and mutate in their defense. In this framework, this paper proposes to address the figure of conscientious objection (CO) to sexual and non-reproductive health, in order to think of interpretative (re)formulations that are the starting point for the discourse of rights to think of possible regulations respectful of women's human rights, while at the same time being a proposal for the construction of citizenship in the face of social fabrics saturated with hate policies. I propose a re-interpretation of CO in the face of the legalization of the interruption of pregnancies, in the light of relational autonomy. For this purpose, I analyze the Argentinean case, taking into consideration the current socio-political context, the importance of the feminist movements in that country, as well as the instrumentalisation of the concept of freedom by the neoconservative political movements that in Argentina have called themselves “libertarian”.
