Federalismo, Direitos e igualdade perante a Lei: Uma aproximação histórico-jurídica ao caso argentino

Abstract

O modelo constitucional argentino combina, como é bem conhecido, uma estrutura política federal com algumas características típicas dos sistemas unitários. Este artigo analisa a tensão entre o sistema de direito material nacional codificado e a reserva em favor das jurisdições provinciais na aplicação dos códigos. Ele procura mostrar que, como resultado dessas tensões, a interpretação dominante validou uma ponderação constitucional na qual a organização do poder jurisdicional tem maior relevância do que o princípio da igualdade perante a lei, com o consequente adiamento de um princípio básico do discurso liberal.

The Argentine constitutional model combines, as is well known, a federal political structure with some typical features of unitary systems. This paper analyzes the tension between the system of codified national substantive law and the preservation of provincial jurisdictions in the application of the codes. It seeks to show that, as an effect of these tensions, the dominant interpretation has validated a constitutional assessment in which the organization of jurisdictional powers has greater relevance than the principle of equality before the law, with the consequent postponement of a basic principle of the liberal discourse.
