Análisis del proyecto de ley de ordenamiento territorial de la provincia del Chaco (Argentina): Su articulación con el marco normativo e institucional vigente

Abstract

Este artículo entiende la política de ordenamiento territorial como un sistema dinámico compuesto por tres elementos estructurales que se encuentran interrelacionados e interdefinidos: el marco normativo, los planes de ordenamiento territorial con sus instrumentos operativos y el modelo de gestión que permite llevarlos a cabo en el territorio. Desde este posicionamiento, que asume un enfoque epistemológico crítico, el marco legal de la política de ordenamiento ambiental del territorio se convierte en objeto de estudio ineludible para el sistema de ordenamiento en Argentina y, en particular, en el Chaco. Ante la inminente aprobación del Proyecto de Ley OT de la Provincia del Chaco, se propone analizar este nuevo instrumento que se sumaría al repertorio de normas actualmente vigentes.

This article understands the territorial planning policy as a dynamic system composed of three structural elements that are interrelated and interdefined: the regulatory framework, the territorial order plans with their operational instruments and the management model that allows them to be carried out in the territory. From this positioning, which assumes a critical epistemological approach, the legal framework of the environmental planning policy of the territory becomes an unavoidable object of study for the planning system in Argentina and, in particular, in the Chaco province. Given the imminent approval of the OT Law Project of the Province of Chaco, it is proposed to analyze this new instrument that would be added to the repertoire of regulations currently in force.
