Acerca de los orígenes del Estado: Una revisión de algunos intentos de delimitación conceptual

Abstract

Este artículo se propone ganar claridad sobre el concepto de Estado, sobre su especificidad y lo que lo diferencia de otros modos de organizar el poder a lo largo de la historia y las latitudes. Esto se basa en la convicción de que, si no tenemos claro qué es el Estado, es posible que queramos utilizarlo para lograr cosas que tiene vedadas o, por el contrario, para evitar otras que forman parte de su esencia.Para lograr este objetivo, el trabajo se ha dividido en dos partes. En la primera, revisamos el caso de Georg Jellinek como ejemplo paradigmático del uso universalista del concepto de Estado. A continuación, presentamos una serie de autores que, con sus matices, se esforzaron por delimitar geográfica y temporalmente el concepto de Estado. Nos referimos a Hermann Heller, Norbert Elias, Otto Brunner, Carl Schmitt y Ernst-Wolfgang Böckenförde. Todos ellos, además, sostienen que las monarquías absolutas fueron la primera manifestación histórica del Estado. Por esa razón, en la segunda parte del artículo nos ocupamos de revisar el origen historiográfico de esta idea, así como algunas de sus críticas. Por último, ofrecemos una recapitulación de lo dicho y algunas conclusiones.

The purpose of this article is to clarify the concept of the state, its specificity and what distinguishes it from other forms of organizing power throughout history and in different latitudes. This is based on the conviction that, if we are not clear about what the State is, we may want to use it to achieve things that are forbidden to it or, on the contrary, to avoid others that are part of its essence. In order to achieve this aim, the paper is divided into two parts. In the first, we examine the case of Georg Jellinek as a paradigmatic example of the universalist use of the concept of the state. We then present a number of authors who, with their own nuances, have attempted to delimit the concept of the state geographically and temporally. We refer to Hermann Heller, Norbert Elias, Otto Brunner, Carl Schmitt and Ernst-Wolfgang Böckenförde. All of them, moreover, argue that absolute monarchies were the first historical manifestation of the state. Therefore, in the second part of the article, we review the historiographical origins of this idea as well as some of its criticisms. Finally, we offer a recapitulation of what has been said and some conclusions.
