La noción de responsabilidad en la justicia penal: El fenómeno social de la "inseguridad" en los trabajadores y trabajadoras de la industria del pescado de Mar del Plata

Abstract

El presente artículo presenta un avance investigativo de un estudio sobre las representaciones de inseguridad y justicia penal en un sector de trabajadores/as de la ciudad de Mar del Plata. Con el objetivo general de desentrañar los factores que promueven una democratización en las reflexiones y juicios morales, nos centramos en identificar la noción de responsabilidad -elemento constitutivo de las nociones de justicia - sobre el fenómeno social de la “inseguridad”. Dicho análisis fue realizado a partir de un abordaje cualitativo aportado por el diseño e implementación de un conjunto de entrevistas clínicas-críticas (Piaget, 1984) a diecinueve trabajadores/as de una de las actividades productivas más importantes de la ciudad: la industria del pescado.Los observables empíricos construidos en nuestro avance de investigación nos permiten discutir el dualismo individuo/sociedad, fuertemente arraigado en nuestro pensamiento occidental, en general, y en las ciencias sociales, en particular; así como problematizar respecto a su función ideológica, es decir, cómo las ideas sobre la justicia y la responsabilidad contribuyen a legitimar y naturalizar las relaciones de poder y las estructuras sociales existentes.

This article presents an investigative progress of a study on the representations of insecurity and criminal justice in a sector of workers in the city of Mar del Plata. With the general objective of unraveling the factors that promote democratization in moral reflections and judgments, we focus on identifying the notion of responsibility - a constitutive element of notions of justice - on the social phenomenon of “insecurity”. This analysis was carried out based on a qualitative approach provided by the design and implementation of a set of clinical-critical interviews (Piaget, 1984) with nineteen workers from one of the most important productive activities in the city: the fish industry. The empirical observables constructed in our research advance allow us to discuss the individual/society dualism, strongly rooted in our Western thought, in general, and in the social sciences, in particular; as well as problematize regarding its ideological function, that is, how ideas about justice and responsibility contribute to legitimizing and naturalizing existing power relations and social structure.
