Delitos odiosos y el valor normativo de la repugnancia: Una crítica a Dan Kahan

Abstract

En este trabajo llamo la atención acerca de un argumento justificatorio del agravante de los delitosde odio vinculado a la idea de repugnancia. Aunque la apelación a la noción de repugnanciapara justificar el reproche de conductas ha sido utilizada por autores clásicos (Lord Devlin), enla actualidad se puede ver un resurgimiento de ella apelando a razones supuestamente liberales(Dan Kahan). Analizo la posición más clara respecto de este punto y muestro por qué estáequivocada. En particular, sostengo que aunque la repugnancia sea una emoción arraigada ennuestra manera de analizar los hechos, la repugnancia de quien evalúa la conducta no puede,en ningún caso, justificar el reproche.

In this paper, I cast doubt on the claim that disgust could be used as justification to aggravate punishment in hate crimes. Although traditional authors (Lord Devlin) have used the emotion of disgust as a way to justify punishment, newly views assert that disgust is not linked only to illiberal justifications of punishment. I analyzed one of the main views on this subject (Dan Kahan) and show why this view is flawed. Particularly, I show that even though disgust is a central emotion in the way how we see some events, the disgust of the officials can never be used as a justification for punishment.
