Enemigos y defensores de la Constitución en Argentina: democracia, república y autoritarismo en los límites del derecho constitucional

Abstract

La defensa de la Constitución constituye un tema prioritario en el derecho constitucional desde hace más de un siglo. El objetivo de este artículo es abordar estas discusiones en Argentina, pero teniendo en cuenta un concepto tradicionalmente olvidado en la literatura constitucional: el de enemigo. Partiendo de la premisa según la cual la pregunta por el defensor de la Constitución supone la del enemigo, en el texto se analizan cuatro instancias donde los enemigos y los defensores de la Constitución se han explicitado: (i) el artículo 29 de la Constitución histórica todavía vigente; (ii) las discusiones en torno a la defensa de la Constitución en la reforma de 1949; (iii) el artículo 36 surgido de la reforma de 1994 y (iv) las decisiones de la Corte Suprema que denegaron la personería jurídica a ciertos partidos políticos. El objetivo es mostrar las inflexiones de las categorías políticas que se han presentado como enemigas de la Constitución, y también de la democracia en Argentina. Esto permite apreciar las tensiones y las paradojas de la pretensión de defender la Constitución por medios legal-constitucionales.

The defense of the Constitution has been one of the most important topics in constitutional law for more than a century. The aim of this article is to study these discussions in Argentina, but taking into account a concept usually forgotten in constitutional literature: the enemy. From the premise that the question of who defends the Constitution also involves identifying its enemies, the work analyzes four moments in which enemies and defenders of the Constitution have been revealed: (i) Article 29 of the historical Constitution, which is still in force; (ii) the discussions around the defense of the Constitution in 1949; (iii) Article 36 approved in the 1994 reform; and (iv) the decisions ruled by the Supreme Court that rejected the legal personality of some political parties. The aim is to show the inflections of the political concepts that have been presented as enemies of the Constitution and democracy. This allows for the examination of the tensions and paradoxes involved in attempting to defend the Constitution through legal and constitutional measures.
