Sobre la cláusula de comandante en jefe de las Fuerzas Armadas en la doctrina constitucional argentina

Abstract

El objetivo del trabajo es revisar las interpretaciones sobre la cláusula constitucional de comandante en jefe de las Fuerzas Armadas en Argentina. Luego de la última dictadura militar, las discusiones en torno al control civil de las Fuerzas Armadas han sido prioritarias en la agenda académica. Se ha destacado que, desde 1983, se buscó efectivizar cláusula de comandante en jefe. Sin embargo, su contenido nunca estuvo del todo claro en la literatura constitucional. En este artículo reviso estas interpretaciones para mostrar cómo se la ha entendido teniendo especialmente en cuenta dos cuestiones señaladas por Samuel Huntington para el caso de Estados Unidos y que no han sido abordadas en nuestro país: por un lado, las posibilidades que ofrece esta cláusula de expandir el poder presidencial en tiempos de emergencia; por el otro, que la comandancia en jefe puede obstaculizar más que promover el control civil sobre las Fuerzas Armadas.

The aim of this work is to review the interpretations of the commander-in-chief clause of the Armed Forces in Argentina. After the last military dictatorship, debates regarding civilian control over the Armed Forces have been a priority. It has been noted that since 1983, democratic governments have sought to implement the commander-in-chief clause effectively. However, its meaning has never been entirely clear in constitutional literature. In this article, I analyze these interpretations to demonstrate how the role of commander in chief of the Armed Forces in Argentina has been understood, particularly considering two issues highlighted by Samuel Huntington concerning the United States: firstly, the potential for this clause to expand presidential powers in times of emergency, and secondly, the possibility that the commander-in-chief role may hinder rather than promote civilian control over the Armed Forces. These issues have not been extensively addressed in Argentine constitutional literature.
