Justicia penal juvenil y reforma legislativa: un análisis sociológico

Abstract

En este artículo se pondrá el foco en el análisis de los proyectos de ley de modificación del régimen penal de la minoridad con trámite parlamentario vigente en 2023, atendiendo a los principales tópicos de controversia que han impedido sancionar un régimen de responsabilidad penal juvenil. A través de un análisis comparativo de los proyectos de ley y sus fundamentos, entendidos como géneros discursivos (Bajtín, 1982), se pretende brindar las coordenadas para la comprensión de la discusión en torno a la edad de reproche penal, el abordaje de los no punibles, las modalidades de resolución alternativa de conflictos que incorporan a la justicia restaurativa y a las medidas no privativas de la libertad, que han sido algunos de los temas en disputa. Asimismo, abrir el interrogante sobre si es posible compatibilizar la justicia restaurativa con modelos de sociedad excluyentes y, sobre todo, si es posible compatibilizar los discursos punitivistas con la ampliación de protecciones y derechos para los más vulnerables.

This article will focus on the analysis of the legal projects to modify the minority penal regime with parliamentary proceedings current in 2023, taking into account the main topics of controversy that have prevented the sanctioningof a juvenile criminal responsibility regime. Through a comparative analysis of the legal projects and their foundations of legislative projects, understood as a discursive genre (Bajtín, 1982), the aimis to provide the axes for the understanding of the discussion around the age of criminal prosecution, the approach to children not punishable, the modalities of alternative conflicto resolution that incorporate restorative justice and non-custodial measures that have been some of the issues in dispute. Likewise, it raises the question of whetherit is posible to make restorative justice compatible with exclusive models of society, and above all whetherit is posible to make punitive discourses compatible with the expansión of protections and rights for the most vulnerable.
