Introducción a un debate por los sujetos de derecho y nuevos otros, en tanto problema jurídico y filosófico

Abstract

Este breve trabajo intentará introducir una conversación esgrimida en torno al texto de Valeria Berros, titulado “Cuando lo obvio deja de serlo: nuevos sujetos y otros en el derecho contemporáneo”. Partiendo de esbozar los principales argumentos que propone la autora, pasaré inmediatamente a apuntar reflexiones suscitadas por la entidad creciente que cobran algunos de los debates que colisionan en la discusión y referiré a sus repercusiones que exceden, a todas luces, el campo del derecho. Intentaré también ofrecer una narrativa que funcione a modo de paraguas argumentativo con la finalidad de esbozar el mapa de relaciones entre los elementos aportados por los comentaristas a la discusión con el texto central y, sin saberlo, entre los mismos comentaristas, Lisbôa y Drivet.

This article attempts to address the discussion around Valeria Berros’s text “When the obvious ceases to be obvious: new subjects and others in contemporary law”. I will start by outlining the main arguments proposed by the author and continue to point out reflections raised by the growing importance of some of the debates aroused in the discussion and I will refer to their repercussions, which clearly exceed the field of law. I also will bring a narrative which may provide an argumentative umbrella to draw the map that links the elements brought by the commentators, Lisbôa and Drivet, related not only to the central text but also among them.
