Cuando lo obvio deja de serlo: Nuevos sujetos y otros en el derecho contemporáneo

Abstract

En este texto presentamos algunos procesos que interpelan el derecho contemporáneo. En particular, nos concentramos en los nuevos sujetos de derecho y en la elasticidad del concepto otro que integra el principio general de no dañar. En un primer apartado analizamos los argumentos en torno a las innovaciones sobre subjetividades jurídicas y otros. En la segunda parte señalamos algunos desafíos que se presentan en incipientes procesos de litigación climática en Argentina en los que aparecen este tipo de conceptos. Finalmente, ilustramos el tema a partir de dos procesos judiciales en curso ante diferentes tribunales argentinos, enfatizando en las principales líneas argumentales utilizadas para el planteo de los conflictos.

This paper aims to present some processes that challenge contemporary law. In particular, we focus on the new subjects of law and on the elasticity of the concept of the other that integrates the harm principle. In the first section we analyze the arguments surrounding the innovations on legal subjectivities and others. In the second part we point out some challenges that arise in incipient processes of climate litigation in Argentina in which this type of concepts appear. Finally, we illustrate the issue based on two ongoing legal proceedings before different Argentine courts, emphasizing the main lines of argument used for the presentation of the conflicts.
