La Ética de los Abogados

Abstract

La hipótesis del presente trabajo es que existe una ética de los abogados –y no simplemente una ética para abogados– que está detrás de los códigos de ética profesional. Los códigos de ética son la cristalización de la reflexión moral que realizan los abogados sobre los problemas que enfrentan en su ejercicio profesional. Esta ética de los abogados ha sido oscurecida por diferentes causas que el trabajo identifica y desmonta. Si la ética de los abogados está detrás de los códigos deontológicos, la reflexión jurídica sobre las razones que subyacen a estos mandatos jurídicos tiene relevancia moral. De manera complementaria, esta reflexión moral tiene relevancia jurídica ya que sirve para interpretar más adecuadamente los códigos.

The hypothesis of the present work is that there is an ethics of lawyers – and not simply an ethics for lawyers – that is behind the codes of professional ethics. The codes of ethics are the crystallization of the moral reflection carried out by lawyers on the problems they face in their professional practice. This ethics of lawyers has been obscured by different causes that the work identifies and dismantles. If the ethics of layers is behind the legal codes of ethics, the legal reflection on the the reasons underlying this legal mandates has moral relevance. In a complementary way, this moral reflection has legal relevance since it serves to interpret the codes more adequately.
