Estado actual del derecho ambiental santafesino en materia de cambio climático, biodiversidad y agroecología

Abstract

Este artículo posee por objetivo analizar las regulaciones en materia de cambio climático, tutela de la biodiversidad y avance de la agroecología en la provincia de Santa Fe. La selección de los temas se relaciona con procesos recientes: la incorporación del cambio climático como eje del diseño institucional del Ministerio de Ambiente y Cambio Climático, la creación a nivel federal de la Dirección Nacional de Agroecología así como los conflictos por la protección de áreas naturales. A su vez, se trata de construir un aporte en materia de derecho ambiental provincial como área poco abordada dentro del campo de la investigación jurídica. Como estructura proponemos, en una primera parte, el desarrollo del eje concerniente a la nueva institucionalidad y legislación santafesina en materia de calentamiento global. Luego enfocamos en las áreas naturales protegidas como estrategia de protección de la diversidad biológica y, por último, en los avances regulatorios en torno a impulsar la agroecología.

The objective of this article is to analyze the regulations on climate change, protection of biodiversity and progress of agroecology in the Province of Santa Fe. The selection of topics is related to recent processes: the incorporation of climate change as the axis of design institution of the Ministry of Environment and Climate Change, the creation at the federal level of the National Directorate of Agroecology as well as the conflicts for the protection of natural areas. In turn, it is about building a contribution in the field of provincial environmental law as an area little addressed within the field of legal research. As a structure we propose, in the first part, the development of the axis concerning the new institutionality and legislation of Santa Fe regarding global warming. Then we focus on protected natural areas as a strategy for the protection of biological diversity and, finally, on regulatory advances around promoting agroecology.
