Autonomía y aborto legal en la Argentina: Análisis del debate parlamentario de la Ley 27.610

Abstract

El 30 de diciembre de 2020 el Congreso de la Nación Argentina sanciona la Ley Nº 27.610 que consagró el acceso a la interrupción voluntaria del embarazo (IVE) y la obligatoriedad de brindar cobertura integral y gratuita. El texto votado fue iniciativa del Poder Ejecutivo que promulgó y puso en vigencia la ley menos de treinta días después. Una de las deudas incumplidas de la democracia argentina se saldó con menos debate público y movilización que dos años y medio antes. Este artículo se focaliza en el análisis del proceso deliberativo que permitió la sanción de la interrupción legal del embarazo en 2020. Por un lado, se relatan, brevemente, los antecedentes del reclamo por la legalización del aborto en la Argentina y se describen algunos elementos distintivos del comportamiento legislativo de las sesiones del 10 y 11 y del 29 y 30 de diciembre de 2020. Por el otro, se analizan los órdenes de argumentos esgrimidos en el debate parlamentario, para identificar los usos políticos del concepto de “autonomía”.

On December 30, 2020, the National Congress of Argentina passed the Law Nº 27.610, which guaranteed the access to voluntary termination of pregnancy (VTP) and the provision of free essential care. The endorsed text was an initiative from the executive power that enacted and enforced the law in less than 30 days. One of the unfulfilled promises of Argentine democracy was finally being fulfilled with less public debate and mobilization than two and a half years before. This article analyzes the deliberative process that gave way to the enactment of the law concerning the legal interruption of pregnancy in 2020. On the one hand, I briefly recount the background of the claims for the legalization of abortion in Argentina and highlight some important elements of the legislative behavior during the sessions of December 10 and 11, and December 29 and 30, 2020. On the other hand, I analyze the arguments that were put forward during the parliamentary debate, so as to identify the political uses of the concept of “autonomy”.
