Teorizar los conflictos para poner en práctica la pertenencia: tres imágenes alternativas al castigo estatal

Abstract

En el presente trabajo intentaremos presentar algunas imágenes alternativas a las del castigo estatal actual. Comenzaremos con Louk Hulsman y la importancia del concepto de situación problemática. Luego analizaremos, según Nils Christie, el dolor como un componente clave para otorgarle sentido a los conflictos. En último lugar, recuperando a Thomas Mathiesen, problematizaremos la justificación del castigo, especialmente aquellas ligadas al retribucionismo, que intenta equiparar el daño que una persona ha generado con aquel que le quiere hacer sufrir.

In the present work we will try to present some alternative images to those of the current state punishment. We will start with Louk Hulsman and the importance of the problem situation concept. Then we will analyze, according to Nils Christie, pain as a key component to give meaning to conflicts. Lastly, recovering Thomas Mathiesen, we will problematize the justification of punishment, especially those linked to retributionism, which tries to equate the damage that a person has generated with that which he wants to make him suffer.
