La incompatibilidad de cargos y sus debates legislativos en una nueva etapa institucional: Entre Ríos, 1860-1879

Abstract

La formación del Estado argentino promovió un intenso y significativo desarrollo institucional arraigado en la creación de nuevos ámbitos de gobierno nacional y también en la transformación de las instituciones provinciales. En el artículo se analiza el diseño que promovería aquellas transformaciones como la adaptación de antiguas prácticas al nuevo marco institucional, en particular porque las visiones de las dirigencias no eran monolíticas y, más allá de los lenguajes y objetivos compartidos, diversos proyectos pugnaron por orientar en direcciones distintas los pasos que debería seguir la construcción del Estado. Por lo tanto cobra relevancia indagar los debates que orientaron el funcionamiento institucional y la creación de nuevos órganos de gobierno en esta etapa para poder restituir las distintas posturas y argumentos que sostuvieron las normas finalmente sancionadas. En este sentido, nos centramos en los debates de la legislatura entrerriana respecto de la incompatibilidad de cargos de los diputados. No nos enfocamos en el debate de una única ley si no que se examinan las discusiones que los legisladores sostuvieron en las décadas de 1860 y 1870, lo cual nos permitirá restituir los distintos argumentos que evidenciaron cómo se pensaba el “deber ser” y el accionar de actores claves para el gobierno provincial y cómo estos argumentos fueron variando a partir de la puesta en práctica de las leyes y el cambio de coyuntura del escenario local y nacional.

The formation of the Argentine state promoted an intense and significant institutional development rooted in the creation of new spheres of national government and also in the transformation of provincial institutions. This article analyses the design that would promote those transformations as the adaptation of old practices to the new institutional framework, particularly its shows that the visions of the leaders were not monolithic and, beyond the shared languages and objectives, different projects struggled to orientate in different directions the steps that the construction of the state should follow. It is therefore important to investigate the debates that guided the institutional functioning and the creation of new government bodies at this stage in order to be able to identify the different positions and arguments that underpinned the rules that were finally sanctioned. In this sense, we focus on the debates in the legislature of Entre Ríos regarding the incompatibility of deputies’ positions. We do not focus on the debate on a single law, but examine the discussions held by legislators in the 1860s and 1870s, which will allow us to reconstruct the different arguments that showed how the “should be” and the actions of key actors in the provincial government were thought and how these arguments changed as the laws were put into practice and as the local and national scenario changed.
