Ley, literatura y justicia: Aproximaciones iusfilosóficas en los textos de Walter Benjamin sobre Franz Kafka

Abstract

El presente trabajo propone determinadas aproximaciones iusfilosóficas al discurso jurídico, a partir de los estudios realizados por Walter Benjamin sobre Franz Kafka. La investigación se realiza con las herramientas metodológicas que aportan las “teorías críticas del derecho” y los marcos teóricos que indagan la relación “derecho-literatura”. Los textos, discusiones y apuntes realizados por el pensador alemán permiten movilizar un análisis de determinados tópicos y categorías pertenecientes al espacio jurídico. Las investigaciones que realiza en torno a la figura de Kafka ofrecen insumos para indagar la formación, despliegue y conservación del derecho. Desde la obra kafkiana, Benjamin visibiliza y desarticula los conceptos nodales de justicia, ley, poder y violencia, lo que permite dar cuenta de los mecanismos y dispositivos que hacen posible el sustento mitológico del derecho.

The present work proposes certain iusphilosophical approaches to legal discourse, based on the studies carried out by Walter Benjamin on Franz Kafka. The study implements the methodological tools provided by the “critical legal studies” and the theoretical frameworks that investigate the “law-literature” relationship. The texts, discussions and notes made by Benjamin allow to mobilize an analysis of certain topics and categories belonging to the legal space. The investigations around the figure of Kafka, offer inputs to investigate the formation, deployment and preservation of the law. From Kafka, Benjamin makes visible and disarticulates the nodal concepts of justice, law, power and violence, which allows to account for the mechanisms and devices that make possible the mythology of law.
