Los derechos sociales: desarrollo jurisprudencial en el ámbito internacional y su recepción en la jurisprudencia de la corte suprema

Abstract

A partir de la reforma constitucional de 1994 se han incorporado numerosos tratados internacionales de derechos humanos con jerarquía constitucional a nuestro ordenamiento interno, por lo que se ha ampliado el catálogo de derechos que el Estado debe garantizar. Asimismo, el Estado se ha obligado a adoptar un enfoque de derechos al momento del diseño y ejecución de las políticas públicas. Dentro de este contexto, el trabajo tratará los derechos económicos, sociales y culturales tomando como base la jurisprudencia y doctrina más reciente, en cuanto a su exigibilidad. Se analizará jurisprudencia nacional e internacional a fin de determinar la recepción en la jurisprudencia argentina de las decisiones, observaciones y recomendaciones de los sistemas internacionales de protección de derechos, en particular el americano. Por último, se pretenderá dar cuenta de los avances y retrocesos en la adopción de dicho enfoque en la jurisprudencia, los logros, fracasos, y limitaciones del mismo.

From the constitutional reform of 1994 some international instruments of human rights have joined withconstitutional hierarchy to our internal classification, by what there has been extended the catalogue of rights that the State must guarantee. Likewise, the State has bound to adopt an approach of rights to apply in the design and execution of the public policies. Inside this context, the paper will deal with judiciability and exigibility of the economic, social and cultural rights taking into account new jurisprudence and the most recent doctrine as a base. There will be analyzed national and international jurisprudence in order to determine the receipt in the Argentine jurisprudence of the decisions, observations and recommendations of the international systems of protection of rights, especially the American. Finally, the paper will try to realize of the advances and setbacks in the adoption of the above mentioned approach in the jurisprudence, its achievements, failures, and limitations.
