Personas anómicas: Sobre la falta de certeza y la subjetividad jurídica en tiempos de pandemia

Abstract

Este trabajo problematiza el concepto jurídico de persona como centro de imputación de normas y obligaciones y asociado a la metáfora de la máscara teatral a la luz de los cambios normativos acaecidos en la pandemia por Covid-19. El punto de partida es pensar la desintegración identitaria y social que resulta de un contexto de anomia en el que la sobreproducción normativa, de vertiginoso cambio y de inseguridad jurídica generan un nuevo tipo de persona. Así, aquí se postula la noción de persona anómica como forma de resaltar el impacto del fenómeno jurídico sobre esta noción central en teoría general del derecho.

This paper problematizes the legal concept of person as the center of imputation of rights and obligations. It is associated with the metaphor of the theatrical mask in light of the normative changes that have occurred in the COVID-19 pandemic. The aim is to think about the identity and social disintegration that results from a context of anomie in which normative overproduction, along with vertiginous change and legal insecurity, generate a new type of person. Thus, here the notion of anomic person is postulated as a way to highlight the impact of the legal phenomenon on this central notion in general theory of law.
