Estado de situación de daños por incendios forestales registrados en Argentina

Abstract

En los últimos veinte años, Argentina ha tenido un fuerte desarrollo forestal, que ha llevado a esta actividad a tener grandes perspectivas de futuro. En ese sentido, las medidas de promoción establecidas han posibilitado la ampliación del área forestada con fines industriales y de protección, y en la actualidad, han llegado a tal magnitud que la ocurrencia de incendios forestalespodría alcanzar un protagonismo poco conocido, con trágicas consecuencias económicas, sociales y medioambientales. Por ello, se presenta como un desafío para los responsables no solo de las áreas de protección, sino también productivas del sector forestal relacionadas con la necesidad de definir políticas de manejo para mantener el fuego dentro de los regímenes naturales. Entre las debilidades del marco normativo, una de las más notorias es que se analiza al ambiente en forma de compartimentos estancos; por otro lado, la sociedad reclama que se realicen propuestas serias de modificaciones elevando las penas y creando nuevos tipos penales que sean específicamente delitos ambientales. Como fortaleza, se destaca la actualización de las normas regulatorias relativas a incendios, sobre todo, relacionado con su ocurrencia en sectores que conservan bosques nativos. Por último, sería importante que los decisores políticos comiencen a considerar una ley integral del ambiente que incluya al que produce e interviene en el ambiente para tal fin, pero que también den la relevancia correspondiente para garantizar su uso responsable y sustentable.

In the last twenty years, Argentina has had a strong forestry development, which has led this activity to have great prospects for the future. In this sense, the promotion measures established have made possible the expansion of the forested area for industrial and protection purposes, and nowadays, they have reached such a magnitude that the occurrence of forest fires could reach a little known protagonism, with tragic economic, social and environmental consequences. Therefore, it is a challenge for those responsible not only for the protection areas, but also for the productive areas of the forestry sector related to the need to define management policies to keep fire within natural regimes. Among the weaknesses of the regulatory framework, one of the most notorious is that it analyzes the environment as a watertight compartment; on the other hand, society is calling for serious proposals for modifications to be made, raising penalties and creating new criminal offenses that are specifically environmental crimes. As a strength, the updating of the regulatory norms related to fires stands out, especially in relation to their occurrence in sectors that conserve native forests. Finally, it would be important that political decision-makers begin to consider a comprehensive environmental law that includes those who produce and intervene in the environment for this purpose, but that also gives the corresponding relevance to guarantee its responsible and sustainable use.
