La soberanía: Desde la perspectiva bodiniana en la recepción de Kelsen, Heller y Schmitt

Abstract

La concepción política que el siglo XX nos ha legado sobre la posición que ocupa la soberanía estatal en el plano nacional e internacional, tiene sus referentes inmediatos en tres grandes autores, correspondientes al estado de Weimar: Herman Heller, Carl Schmitt y Hans Kelsen, con posiciones discrepantes que veremos someramente. Es principalmente en el acento que ponen del papel jurídico de la soberanía política donde se muestra el influjo que Jean Bodin ha tenido en los dos autores alemanes mencionados primeramente. Del poder soberano se desprende la positividad del derecho pues la ley es el instrumento principal del poder político.

The conception of politics that the twentieth century has left us about the position that the State sovereignty occupies in the national and international level has its immediate reference point in three great authors who belong to the State of Weimar: Herman Heller, Carl Schmitt y Hans Kelsen. These authors have differing positions that will be cursorily covered perfunctorily. It is mostly in the emphasis they make on the legal role of political sovereignty where Jean Bodin’s influence that has had on the German author previously mentioned is shown. The positivity of law arises from the Sovereign Power since law is the main instrument of the political power.
