Sentido y valor del orden constitucional en las obras troncales de hermann heller: weimar y los ethische rechtsgrundsätze

Abstract

En las siguientes páginas se estudiarán algunos rasgos salientes del abordaje político-sociológico que hace Hermann Heller de la realidad de la constitución. Ese análisis permitirá observar cómo la realidad empírica misma de la organización constitucional no se explica —ni menos se legitima— sino merced a los principios ético-jurídicos fundamentales (ethische Rechtsgrundsätze). La Constitución de Weimar ofrece un ilustrativo ejemplo de esta concepción central de la filosofía política y jurídica de Hermann Heller. La fuente para esta tarea será la compulsa de las obras principales del gran teórico del Estado.

This article deals with some salient features of Hermann Heller´s political-sociological approach to the reality of the constitution. In so doing it can be verified how the empirical reality itself of the constitutional organization is not explained - not least legitimized - but thanks to the fundamental ethical-legal principles (ethische Rechtsgrundsätze). The Weimar Constitution provides an illustrative example of this central conception of Hermann Heller´s political and legal philosophy.The sources for this task are the main systematic works of the great theoretician of the State.
