Competencias profesionales en la fabricación de productos médicos en Argentina

Abstract

En este trabajo exponemos a qué profesiones se les debe otorgar competencia en la dirección técnica de laboratorios o de plantas responsables de la fabricación, importación y distribución de productos médicos en Argentina. Utilizamos la Matriz de Datos de la Sociología para recoger información operada a través de los métodos jurídico, realista y bibliográfico. Las variables asignadas en el diseño metodológico responden a los campos del Derecho de la Salud; el Derecho Administrativo; el Derecho Comparado; a las Competencias conferidas por el plan de estudios de Ingeniería Biomédica/Bioingeniería y Farmacia respectivamente, y; el Rol del Estado. Concluimos que tal competencia debe ser concedida a los Ingenieros Biomédicos. En contraposición, encontramos que el cumplimiento de los requisitos del sistema de calidad por los que debe atravesar un producto médico se halla viciado, derivando en la posible consideración del mismo como un “producto no-conforme”. Sostenemos que la normativa actual de ANMAT presenta antinomias, transgrede principios y vocablos subyacentes al Derecho, y provoca desprotección jurídica de la salud del paciente argentino. Establecemos que el Estado Nacional posee obligaciones positivas de intervenir en esta controversia.

In this paper, we explain to which professions should be given competence in the technical direction of laboratories or plants responsible for the manufacture, importation and distribution of medical products in Argentina. We use the Data Matrix of Sociology to collect information operated through legal, realistic and bibliographic methods. The variables assigned in the methodological design belong to the fields of Health Law; Administrative Law; Comparative Law; Competences conferred by the curriculum of Biomedical Engineering / Bioengineering and Pharmacy respectively, and; The Role of the State. We conclude that competition must be granted to Biomedical Engineers. In contrast, it is found that the fulfillment of the requirements of the quality system for what must pass through a medical product is vitiated, resulting in a possible consideration of the same as a “non-compliant product.” We agree that the current regulations of ANMAT present antinomies, transgress principles and words underlying the law, and provoke the legal lack of protection of the health of the Argentine patient. We establish that the National Government has positive obligations to intervine in this controversy.
