El derecho en tensión: Las sociedades indígenas del nordeste argentino y las implicancias de sus cosmovisiones en la práctica jurídica

Abstract

El presente trabajo intentará acercarnos a los orígenes del choque cultural y de cosmovisionesde las sociedades indígenas y las sociedades “blancas” que repercute, entre otros, en el ámbitodel derecho. Durante muchos años el Estado Argentino omitió reconocer y proteger através de las leyes los derechos de los diversos pueblos indígenas que forman parte delpropio Estado, perdiendo de vista que Argentina es una nación multicultural, y que comoconsecuencia de ello, existían pueblos y/o comunidades indígenas que se encontrabanregidos por sus usos y costumbres, los cuales no eran reconocidos ni protegidos por el Estado como parte de su sistema jurídico. La normativa argentina, en los últimos tiempos,ha buscado aprehender la diferencia cultural de las sociedades indígenas para volver así alderecho más real, pluralista e inclusivo.

The present work will try to approach the origins of the culture and worldview clashes of indigenous societies and “white” societies that have an impact, among others, in the field of law. For many years the Argentine State failed to recognize and protect through the laws the rights of the indigenous peoples that are part of the State itself, losing sight of the fact that Argentina is a multicultural nation, and that as a consequence, there were peoples and / or indigenous communities that were governed by their uses and customs, which were not recognized or protected by the State as part of their legal system. Argentine legislation, in recent times, has sought to apprehend the cultural difference of indigenous societies in order to make the right more real, pluralistic and inclusive.
